01Use of Our Website

These Terms of Service (“Terms”) govern your access to and use of mykopeks.com (the “Site”) and your purchase and use of products and services offered through the Site. KOPEKS is a brand operated by Onix Venture Group (“KOPEKS,” “Onix Venture Group,” “we,” “us,” or “our”). By accessing the Site, placing an order or otherwise using our services, you agree to these Terms.

You may use our Site only for lawful purposes and in accordance with these Terms.

By using the Site, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian where required.

You agree not to use our Site, products or services for any unlawful, fraudulent, abusive or unauthorized purpose.

We reserve the right to refuse service, cancel orders, restrict access or terminate use of the Site when reasonably necessary to protect our customers, our business or our legal rights.

02Products, Pricing & Availability

We make reasonable efforts to provide accurate descriptions, photographs, dimensions, specifications, pricing and other product information.

However, product colors, fabric textures and appearance may vary slightly due to lighting, photography, manufacturing variations, screen settings and other factors.

Prices and product availability, including specific sizes and cover fabrics, are subject to change without notice.

We reserve the right to correct errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, availability or other information.

If an error affects an order you have already placed, we may contact you with the correct information or cancel the affected portion of the order and issue an appropriate refund.

We may discontinue or modify products at any time.

03Product Dimensions, Fit & Care

KOPEKS beds are offered in specific sizes, and our replacement covers and waterproof liners are cut to fit KOPEKS beds:

• Large: 35" x 28" x 5.5"
• Extra Large: 50" x 34" x 7" memory foam with a 2.5" pillow

Customers are responsible for reviewing the product dimensions, specifications, compatibility information and size guidance on the applicable product page before purchasing, and for choosing a size that suits their dog.

Unless expressly stated otherwise, measurements are approximate and minor manufacturing variations may occur.

Replacement covers and liners are designed for KOPEKS beds of the same size. Fit on beds from other brands is not guaranteed.

Please follow the care label: the outer cover is removable and machine washable, and it should be fully dry before reuse. Never machine wash the memory foam. Damage caused by improper care may not be covered under our warranty.

Nothing in this section limits any rights you may have under applicable consumer protection law.

04Orders

When you place an order, you are making an offer to purchase the products in your order.

Receipt of an order confirmation does not necessarily mean that we have accepted the order. We reserve the right to accept, decline, limit or cancel an order where reasonably necessary, including in cases involving:

• Suspected fraud or unauthorized transactions.
• Incorrect pricing or product information.
• Product availability issues.
• Payment authorization problems.
• Orders that appear to be placed for unauthorized resale.
• Errors affecting inventory or fulfillment.
• Violations of these Terms.

If we cancel an order after payment has been successfully processed, we will issue a refund for the canceled portion of the order.

We may limit quantities purchased per person, household, account, order, payment method or shipping address where reasonably necessary.

05Payment

You agree to provide current, complete and accurate billing and payment information when making a purchase.

Payments are processed through Shopify and/or applicable third-party payment providers.

Your use of certain payment methods or services may also be subject to additional terms established by the applicable payment provider.

We are not responsible for fees independently imposed by your bank, credit card issuer or other financial institution.

06Shipping & Delivery

Shipping options, estimated delivery times and applicable shipping charges are displayed during checkout or otherwise provided on our Site. We offer free standard shipping on U.S. orders of $60 or more.

Delivery dates and transit times are estimates unless expressly stated otherwise. Delays may occur due to carriers, weather, holidays, incorrect addresses, high shipping volumes or circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate shipping information.

07Returns, Refunds & Warranty

Purchases from KOPEKS are subject to our current Returns & Refunds policy, which describes eligibility requirements, the return period, product-condition requirements, exclusions and refund procedures. In summary:

• Returns must be requested within 30 days of delivery; after 30 days we cannot offer a refund or exchange.
• Because our beds ship compressed, the original retail packaging is not required for a return.
• To start a return, email customerservice@onixventuregroup.com.
• Return shipping is paid by the customer and shipping costs are non-refundable.
• Only regular-priced items can be refunded; sale items cannot be refunded.

1-Year Warranty

KOPEKS products are backed by a 1-year manufacturer warranty from the original date of purchase, covering defects in materials and workmanship under normal use. Coverage applies to the original purchaser, and proof of purchase or an order number may be required. If a product is determined to have a covered defect, KOPEKS may, at its discretion, repair the product, replace it or provide store credit. To make a claim, email us or visit our Contact Us page.

Customers should review the Returns & Refunds policy before making a purchase. Nothing in that policy or these Terms is intended to exclude or restrict consumer rights that cannot legally be excluded or restricted.

08Intellectual Property

The Site and its content are owned by or licensed to Onix Venture Group and are protected by applicable intellectual property laws.

This includes, without limitation:

• KOPEKS names and logos.
• Product photography and lifestyle images.
• Graphics and illustrations.
• Videos.
• Product descriptions and written content.
• Website designs and layouts.
• Product guides, care and instructional materials.
• Icons and other visual assets.
• Trademarks and branding.

You may access and use the Site for your personal, non-commercial shopping purposes.

Unless we provide prior written permission, you may not copy, reproduce, modify, distribute, republish, sell, license, scrape, commercially exploit or create derivative works from our Site content.

Nothing in these Terms transfers ownership of any KOPEKS or Onix Venture Group intellectual property to you.

09Reviews & User Content

You may have the opportunity to submit product reviews, photographs (including photos of your dog), comments, feedback, suggestions or other content (“User Content”).

You are responsible for the User Content you submit and represent that you have the necessary rights to submit it.

By submitting User Content to us, you grant Onix Venture Group a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish and distribute that content in connection with operating, promoting and marketing KOPEKS and our products, subject to applicable law.

We may remove or decline to publish content that we reasonably believe is unlawful, fraudulent, abusive, misleading, infringing, obscene or otherwise inappropriate.

We are not obligated to compensate you for unsolicited ideas, suggestions or other feedback.

10Third-Party Services & Links

Our Site may use or contain links to third-party websites, applications, payment services, social media platforms, shipping providers or other services.

Third-party services are governed by their own terms and privacy practices.

We do not control and are not responsible for the content, availability, security or practices of independent third-party websites or services.

You should review the applicable terms and policies before using third-party services.

11Shopify

Our online store is hosted on Shopify, which provides the ecommerce platform that enables us to offer our products and services online.

Certain features of our Site, checkout, payments, accounts or other services may therefore be provided or supported by Shopify or its related services.

Your use of Shopify’s consumer-facing services may be subject to Shopify’s own applicable terms and policies.

12Prohibited Uses

You may not use the Site:

• For unlawful or fraudulent activities.
• To violate applicable laws or regulations.
• To infringe intellectual property or other legal rights.
• To transmit malicious software, viruses or harmful code.
• To interfere with the security or operation of the Site.
• To attempt unauthorized access to accounts, systems or data.
• To collect or scrape Site content or customer information without authorization.
• To impersonate another person or misrepresent your identity.
• To submit false or misleading information.
• To engage in abusive, threatening or harmful conduct.
• To use automated systems in a manner that materially interferes with operation of the Site.

We may restrict or terminate access to the Site for violations of these Terms.

By using the Site, you acknowledge our privacy practices as described in the Privacy Policy.

14Disclaimer of Warranties

Except as expressly provided in the KOPEKS 1-year warranty or as required by applicable law, the Site and its content are provided on an “as available” basis.

We make reasonable efforts to maintain accurate and reliable information and Site functionality, but we do not guarantee that the Site will always be uninterrupted, error-free, secure or available.

Any warranties expressly provided with KOPEKS products are governed by the warranty terms described in Section 7.

Nothing in these Terms excludes warranties, guarantees or other rights that cannot lawfully be excluded under applicable consumer protection laws.

15Limitation of Liability

To the maximum extent permitted by applicable law, Onix Venture Group and its affiliates, officers, employees, agents, contractors, suppliers and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your use of the Site or products purchased through the Site.

This may include, where permitted by law, loss of profits, revenue, data, business opportunities or other intangible losses.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law.

16Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Onix Venture Group and its affiliates, officers, employees, agents, contractors, licensors and service providers from claims, liabilities, damages and reasonable expenses arising from your material violation of these Terms, misuse of the Site or infringement of another party’s rights.

17Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will remain valid and enforceable.

18No Waiver

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

19Governing Law

These Terms and any dispute arising from or relating to these Terms or your use of the Site will be governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable consumer protection laws provide otherwise.

Nothing in this section deprives consumers of protections or rights that cannot be waived under applicable law.

20Changes to These Terms

We may update these Terms periodically to reflect changes to our business, products, Site, practices or legal requirements.

When changes are made, we will update the “Last Updated” date at the top of this page.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

21Entire Agreement

These Terms, together with our Privacy Policy, Returns & Refunds policy, Shipping & Delivery policy and other policies expressly incorporated by reference, constitute the applicable agreement between you and Onix Venture Group regarding your use of the KOPEKS Site and purchases made through it.
